Overview: This document outlines the terms and conditions ("Agreement") under which our Techcom GPS tracking company ("Provider") provides vehicle GPS tracking services ("Service") to the customer ("Customer").
Use of Service: The Customer agrees to use the Service only for lawful purposes and comply with all applicable laws and regulations. If the Customer uses the Service in violation of this Agreement, the Provider reserves the right to suspend or terminate the Service.
Equipment: The Provider will provide GPS tracking devices to the Customer or the Customer will purchase GPS tracking devices from the Provider ("Equipment") to be installed in the Customer's vehicle. The Customer is responsible for installing the Equipment in their vehicle and ensuring its maintenance and proper operation.
Fees and Payment: The Customer agrees to pay the Service fees as set forth in the Provider's pricing table. The Provider reserves the right to change the pricing table at any time and notify the Customer within a reasonable notice period. The Customer agrees to pay all fees timely in accordance with the payment terms set forth in the pricing table.
Data and Privacy: The Provider will collect and store data, including location and vehicle data, from the Equipment. The Provider will only use this data to provide the Service and will not disclose this data to any third party without the Customer's consent, except as required by law or court order. The Provider will take reasonable measures to protect the data from unauthorized access or disclosure.
Limitation of Liability: The Provider shall not be liable for any direct, indirect, special or consequential damages arising from the use of GPS tracking devices, including but not limited to vehicle or Equipment damage, inaccurate location, interrupted information transmission, data loss, false alarms, etc. The Customer shall be fully responsible for the use of the Equipment, including installation, maintenance and operation of the Equipment. If the Equipment is damaged or fails, the Provider is only responsible for replacing the Equipment and shall not assume any other liability. The Customer shall be solely responsible for any losses or liabilities arising from the use of the Equipment.
Termination: Either party may terminate this Agreement upon notice to the other party at any time. Upon termination, if the Customer is a lease customer, they must return the Equipment in good condition to the Provider. If the Customer is a one-time GPS equipment purchaser, they are not required to return the Equipment to the Provider. The Provider may also immediately terminate this Agreement if the Customer violates any of its terms.
